A “contractor” is any person engaged in the business of construction, repair, alteration, dismantling, or demolition of bridges, highways, roads, streets, buildings, airports, dams, pipelines, and every other type of structure, project, development, or improvement coming within the definition of real or personal property, including the construction, alteration, or repair of property to be held either for sale or rental, and shall include subcontractor, public contractor, and nonresident contractor.
No person may engage in the business nor act in the capacity of a contractor within this state when the cost, value, or price per job exceeds the sum of $4,000 without first having a license.
43-07-07. Classes of licenses – License fees – License renewal fees.
1. Four classes of licenses may be issued under this chapter, which must be designated
as class A, B, C, and D licenses. A holder of a license may engage in the contracting
business within this state subject to the following limitations:
a. The holder of a class A license is subject to no limitation as to the value of any
single contract project.
b. The holder of a class B license is not entitled to engage in the construction of any single contract project of a value in excess of five hundred thousand dollars. c. The holder of a class C license is not entitled to engage in the construction of any single contract project of a value in excess of three hundred thousand dollars. d. The holder of a class D license is not entitled to engage in the construction of any single contract project of a value in excess of one hundred thousand dollars. 2. When applying for a license as described and required in this chapter, the applicant shall pay to the registrar the following fees: a. For a class A license, the sum of four hundred fifty dollars. b. For a class B license, the sum of three hundred dollars. c. For a class C license, the sum of two hundred twenty-five dollars. d. For a class D license, the sum of one hundred dollars. 3. For a certificate of renewal for a license, the licensee shall pay to the registrar the following fees: a. For a class A license, the sum of ninety dollars. b. For a class B license, the sum of sixty dollars. c. For a class C license, the sum of forty-five dollars. d. For a class D license, the sum of thirty dollars. 4. Twenty-five percent of all moneys collected by the registrar under this chapter must be deposited in the secretary of state’s general services operating fund to pay the cost to administer this chapter and the balance of the moneys collected must be deposited with the state treasurer, who shall credit them to the general fund of the state.

“Class B electrician” means a person having the necessary
qualifications, training, and technical knowledge to wire, install,
and repair electrical apparatus and equipment in accordance with
the standard rules and regulations governing such work, and shall
have eighteen months’ experience in farmstead or residential
wiring, and shall have passed an examination before the state
electrical board based upon the national electrical code as it
applies to farmstead or residential wiring.
4. “Journeyman electrician” means a person having the necessary
qualifications, training, and technical knowledge to wire, install,
and repair electrical apparatus and equipment in accordance with
the standard rules and regulations governing such work.
5. “Master electrician” means a person having the necessary
qualifications, training, experience, and technical knowledge to
plan, lay out, and supervise the installation and repair of electrical
wiring apparatus, and equipment for electric light, heat, and power
in accordance with the standard rules and regulations governing
such work.

2. “Journeyman plumber” means any person, other than a master plumber, who, as the person’s principal occupation, is engaged in the practical installation, alteration, and repair of plumbing.
3. “Master plumber” means a person skilled in the planning, supervision, and the practical installation, alteration, and repair of plumbing, and familiar with the laws, rules, and regulations governing the same.
4. “Plumber’s apprentice” means any person other than a journeyman or a master plumber, who, as the person’s principal occupation, is engaged in learning and assisting in the installation, alteration, and repair of plumbing and drainage, under the immediate and personal supervision of either a master or a journeyman plumber.
5. “Plumbing” means the installation, maintenance, extension, alteration, and removal of all piping, plumbing fixtures, plumbing appliances, and other appurtenances in connection with bringing water into, and using the same in buildings, and for removing liquids and water-carried wastes therefrom.

ASBESTOS CONTRACTOR LICENSE APPLICATION FEE: $150.00
Asbestos inspector – Any person who inspects facilities for asbestos-containing materials. Only certified asbestos inspectors may take samples for asbestos analysis.
Asbestos management planner – Any person who develops facility plans for the management of asbestos-containing materials.
Asbestos abatement project designer – Any person who develops the plans, specifications and designs for an asbestos abatement project.
Asbestos abatement supervisor – Any person employed by the asbestos contractor, including a public employee, who supervises certified workers engaged in asbestos removal, encapsulation, enclosure and repair. Supervisors may include those individuals with the position title of foreman, working foreman or lead-man pursuant to collective bargaining agreements.
Asbestos abatement worker – An employee or agent of an asbestos contractor, or a public employee engaged in the abatement of more than three square feet [0.28 square meters] or three linear feet [0.91 meters] of friable asbestos material, except for individuals engaged in abatement work at their private residences.
Asbestos abatement project monitor – Any person employed to monitor an asbestos removal project to ensure any of the following:
- The removal is conducted in accordance with state and federal regulations.
- State-of-the-art work practices are employed.
- The abatement is conducted as designed.
- Personal and ambient air samples are collected properly.
Asbestos abatement project monitors working in North Dakota also must be certified by the state as either an asbestos abatement project designer or an asbestos abatement supervisor. Project designers who do not ensure that personal and ambient air samples are collected properly and employees of the asbestos removal contractor do not need to be certified as project monitors to perform the services above when working on their own projects.
